Amnistía Internacional México ha hecho un llamado el día de hoy al Senado de la República a no ratificar el Acuerdo Comercial contra la Falsificación (ACTA, por sus siglas en inglés) recientemente firmado por el Presidente Calderón.

El ACTA es un tratado internacional que busca incrementar los controles relativos a la falsificación de mercancías y marcas; sin embargo, este instrumento no garantiza un adecuado equilibrio entre la protección de los derechos de propiedad intelectual y el derecho a la libertad de expresión y al debido proceso que deben garantizar los Estados.

“Es legítimo el esfuerzo de los Estados por preservar los derechos de propiedad intelectual, pero nunca a costa de una restricción tan significativa a derechos fundamentales como la libertad de expresión y el debido proceso” ha dicho hoy Alberto Herrera Aragón, Director Ejecutivo de Amnistía Internacional México.

El pasado 11 de julio, el Presidente Felipe Calderón firmó el ACTA, a pesar de los polémicos antecedentes en la redacción y discusión de este tratado por las consecuencias que podría traer para la libertad de expresión, en particular en lo relativo al uso del internet como medio de intercambio de información.

“El libre flujo de información a través del internet ha significado una importante herramienta para la participación de la población en asuntos públicos y ha permitido una amplia movilización social para exigir una gran variedad de derechos; por ello, ningún instrumento legal debe poner en riesgo la libertad de expresión vinculada al uso de redes virtuales” dijo Herrera.

Para que el ACTA entre en vigor se requiere la ratificación de este tratado por al menos seis Estados. La firma de este instrumento por parte del Presidente Calderón es un primer paso dirigido hacia su ratificación, cuya facultad última recae en el Senado de la República.

“Debido a las implicaciones que en materia de derechos humanos podría tener la entrada en vigor de un tratado internacional comercial con estas características, hacemos un llamado al Senado de la República a no ratificarlo mientras no existan modificaciones sustantivas que aseguren que la libertad de expresión y el debido proceso serán garantizados”, concluyó Herrera.
