Exigimos el retorno inmediato del preso político al CERSS No. 5, SCLC.

A nueve meses el órgano federal a través del Primer Tribunal Colegiado del Vigésimo Circuito en el estado de Chiapas, dio a conocer el día de hoy, la sentencia que hace un mes (el 14 de junio de 2012) emitió el Segundo Tribunal Colegiado de Circuito del Centro Auxiliar de la Octava Región, con sede en Cancún, Quintana Roo, que resuelve el amparo promovido por este Centro de Derechos Humanos Fray Bartolomé de Las Casas (Frayba) a favor del profesor tsotsil Alberto Patishtán Gómez (en adelante Alberto Patishtán) contra el traslado injustificado y forzoso ocurrido el 20 de octubre de 2011 al Centro Federal de Readaptación Social (Cefereso No. 8), en Guasave, Sinaloa, México, cuando Alberto Patishtan se encontraba en huelga de hambre exigiendo su libertad, junto con un grupo de presos injustamente, denominados “Solidarios de la Voz del Amate”.

El Tribunal de Segunda Instancia confirma el amparo que ordena el regreso de Alberto Patishtán del Cefereso No. 8 al Centro Estatal para la Reinserción Social de Sentenciados No. 5 (CERSS No. 5), de San Cristóbal de Las Casas, Chiapas, en donde se encontraba anteriormente.

Pasaron nueve meses de dilación al proceso con el argumento de “cumplir procedimientos establecidos institucionalmente”, debido al recurso de revisión interpuesto por el Director de Amparos de la Unidad de Asuntos Legales y Derechos Humanos del Órgano Administrativo Desconcentrado, Prevención y Readaptación Social dependiente de la Secretaría de Seguridad Pública Federal.

Durante el proceso judicial el Frayba documentó violaciones al derecho a la integridad personal, al derecho de las personas privadas de su libertad, derecho a la salud, derecho a un recurso judicial sencillo, rápido y efectivo, así como la obstaculización a una defensa adecuada. Derechos que el Estado mexicano se ha comprometido cumplir al firmar y ratificar varios instrumentos internacionales.

Por lo antes mencionado, el Frayba exige el cumplimiento efectivo de la sentencia de amparo, por lo que Alberto Patishtán debe ser trasladado inmediatamente al CERSS No. 5 de San Cristóbal de Las Casas, Chiapas, instamos a las autoridades responsables a que a la brevedad cumplan con la sentencia sin dilación alguna.

Así también, exigimos la libertad inmediata de Alberto Patishtán, porque las acusaciones dictadas en su contra resultan inconsistentes e injustas, ya que no cometió ningún delito de los que se le acusa y que lo mantiene preso desde hace 12 años.

Finalmente, agradecemos a todas las personas, colectivos y organizaciones nacionales e internacionales por su solidaridad y participación, les invitamos a seguir la digna lucha del profesor tstotsil Alberto Patishtán para alcanzar su inmediata libertad.
